Acceptable Use Policy
This Acceptable Use Policy (“AUP”) forms a binding component of Desku’s Terms and governs how Users may access and use the Desku platform, including its web application, AI Features, APIs, integrations, messaging channels, and all related services (the “Service”). By accessing or using the Service, you acknowledge and agree to comply with this AUP and all applicable laws, regulations, platform rules, and industry standards.
The purpose of this AUP is to protect the safety, reliability, and integrity of the platform, its Users, and the systems and integrations connected to Desku. It outlines both acceptable and prohibited conduct, including requirements for responsible use of AI Fatures and third-party messaging or communication channels.
Violation of this AUP may result in warnings, feature restrictions, suspension, or immediate termination of your account, depending on the severity and frequency of the violation. Desku reserves the right to enforce this AUP at its discretion to maintain platform stability and legal compliance.
Definitions
For purposes of this Acceptable Use Policy (“AUP”), the following terms apply:
“AI Features”
Desku’s AI-powered functionalities, including automated responses, generative content, suggestions, summaries, predictions, and any other machine-assisted outputs produced within the platform.
“Customer”
A business entity, organization, or authorized individual who accesses or uses the Service. The person creating the account represents that they have authority to bind the Customer.
“Customer Content / Data”
Any data, text, media, files, messages, or other materials submitted, generated, transmitted, or stored through the Service by a User or on their behalf.
“Documentation”
All written or digital instructions, help articles, onboarding guides, product descriptions, and technical materials provided by Desku.
“Effective Date”
The date at which changes related to the Service, or Policies, or Terms & Conditions become effective. Continued usage of the Service after the Effective Date denotes the acceptance of said changes.
“Integrations”
Officially supported connections between Desku and third-party providers, such as WhatsApp Business, Facebook Platform, Shopify, Telegram, Slack, and other compatible systems.
“Messaging Channels”
Any communication pathways linked to Desku, including Live Chat widgets, email, WhatsApp, social messaging apps, and any other channel enabled by the User.
“Prohibited Content”
Any content defined as restricted or disallowed under Section 5 of this AUP.
“Service”
Refers to the full Desku platform, including the web application, dashboard, API, AI features, automation tools, integrations, messaging channels, and all related components provided to Users.
“Subprocessors”
Third-party vendors or service providers engaged by Desku to support the hosting, maintenance, delivery, or operation of the Service.
“Third-Party Services”
External applications, platforms, or systems not owned or controlled by Desku that Users may choose to integrate with or utilize alongside the Service.
“User”
An individual or business entity that accesses or uses the Service, whether directly or through an authorized representative. This includes all agents, staff members, contractors, and administrators operating under a Customer’s account.
General Responsibilities of Users
Users are required to use the Service responsibly and in full compliance with this AUP, the Terms, and all applicable laws. By accessing the platform, Users agree to:
Failure to comply with these responsibilities may result in warnings, access restrictions, suspension, or termination of the User’s account at Desku’s discretion.
Prohibited Activities
Performance Monitoring
Users are strictly prohibited from using the Service for any activity that is illegal, harmful, abusive, or otherwise dangerous. This includes, but is not limited to:
Participating in or supporting wildlife trafficking, exploitation, or activities that cause harm to individuals, animals, or the environment.
Users are solely responsible for the legality of the content they submit. Desku disclaims all responsibility for infringing materials uploaded by Users.
Any violation of this section may result in immediate suspension, access restriction, or termination of the User’s account, at Desku’s sole discretion.
Security Violations
Users are strictly prohibited from engaging in any activity that compromises, attempts to compromise, or could reasonably be expected to compromise the security, stability, or integrity of the Service. This includes:
Deploying, distributing, or transmitting malware, ransomware, viruses, bots, scrapers, harmful scripts, automated extraction tools, or performing denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
Any violation of this section may result in immediate suspension, restricted access, or permanent termination of the User’s account, at Desku’s sole discretion.
AI Misuse
To ensure the safe, responsible, and compliant use of Desku’s AI Features, Users are strictly prohibited from:
Attempting to reverse engineer, extract, replicate, or recreate Desku’s AI models, system behavior, or underlying architecture.
Desku is not liable for inaccurate, incomplete, misleading, or “hallucinated” AI outputs, including those created due to User-provided instructions, configurations, or data.
All AI responses are provided for informational purposes only. Users are fully responsible for reviewing, validating, and ensuring that AI-generated content complies with all applicable laws, regulations, industry standards, and internal business requirements before acting upon it.
Prohibited Content
Users are strictly prohibited from uploading, generating, transmitting, or distributing any of the following types of content through the Service or connected Messaging Channels:
Graphic violence, depictions of physical injury, or content intended to shock, traumatize, or cause emotional distress.
Fraudulent activity, financial scams, phishing attempts, unlicensed investment schemes, or deceptive promises of financial gain or earnings.
Violation of this section may result in content removal, temporary suspension, feature restrictions, or immediate termination of the User’s account, at Desku’s sole discretion.
Fair Use and Rate Limits
Users must operate within all usage thresholds, technical limits, and fair-use guidelines established by Desku. These limits may apply to API usage, AI Processing, messaging volume, integration activity, and any other component of the Service.
Desku maintains documented rate limits (link to be added), including:
API request quotas and per-second limits
AI Processing and inference usage limits
Messaging and outbound communication thresholds
Integration-specific restrictions (e.g. WhatsApp, Facebook, Shopify)
Users are responsible for reviewing and complying with the limits published within the Desku Documentation, dashboard, or integration settings.
Desku may adjust fair-use thresholds at any time based on platform load, system performance, technical requirements, or security considerations. What constitutes “reasonable use” is determined solely at Desku’s discretion.
If a User exceeds documented or system-enforced limits, Desku may take one or more of the following actions:
Automatically throttle or reduce request throughput
Apply usage caps or temporarily restrict access to certain features
Suspend API connectivity or messaging capabilities
Fully suspend or terminate account access for repeated or abusive overuse
API and Developer Restrictions
Users must comply with all technical, operational, and security requirements when accessing or developing on Desku’s API. To maintain platform stability and protect system integrity, the following activities are strictly prohibited:
Attempting to reverse engineer, decompile, disassemble, or otherwise derive the underlying source code, logic, structure, or architecture of the API or any component of the Service.
Bypassing, modifying, or circumventing rate limits, authentication processes, quota rules, access controls, or any other technical safeguards implemented by Desku.
Exporting, harvesting, scraping, or aggregating data from the API for the purpose of developing, training, or supporting a competing platform, AI model, machine learning system, or service.
Selling, sublicensing, leasing, renting, or redistributing API access, data, or outputs to third parties without explicit written permission from Desku.
Using automated systems, bots, scripts, or high-volume processes that overload, degrade, abuse, or interfere with the stability or performance of Desku’s infrastructure.
Building integrations or tools that materially replicate core Desku functionality, misrepresent Desku, or violate policies of connected third-party services.
Any violation of these API restrictions may result in immediate suspension or termination of API access and may trigger additional enforcement actions where necessary.
Integrations and Third-Party Services
Users must follow all policies, rules, and technical requirements associated with any third-party service connected to the Desku platform, including but not limited to WhatsApp Business, Facebook Platform, Shopify, Slack, and Telegram, etc..
By enabling or using an integration, Users acknowledge and agree that:
Each third-party provider sets its own terms, usage limits, content policies, and compliance requirements.
Users are responsible for reviewing, accepting, and adhering to those terms at all times.
Third-party platforms may modify their APIs, rate limits, features, or availability without notice, and such changes may impact the functionality of the integration within Desku.
Desku does not control and is not liable for any downtime, delays, disruptions, API errors, data loss, or performance issues originating from third-party systems.
Users remain solely responsible for ensuring that their continued use of any integration complies with the policies of the respective third-party service.
Desku may disable or restrict certain integrations if required by a third-party provider, for security reasons, or to protect system integrity.
High-Risk Use Cases
Users must not use Desku for any activity that involves high-risk, safety-critical, or time-sensitive outcomes. Prohibited use cases include, but are not limited to:
Medical or Clinical Use:
Medical diagnosis, clinical assessments, treatment recommendations, triage, or any activity that requires licensed healthcare professionals.
Emergency or Life-Safety Functions:
Emergency response, life-support systems, real-time monitoring for critical environments, or any function where failure could result in injury or death.
Professional-Regulated Advice:
Legal, financial, tax, regulatory, or compliance advisories that must be provided by certified or licensed professionals.
Crisis or Mental-Health Intervention:
Suicide prevention, crisis counselling, mental-health emergency support, or urgent-care assistance of any kind.
Disclaimer
Desku’s platform, including all AI Features, is not designed, intended, or certified for emergency, medical, legal, financial, or other safety-critical purposes.
Desku disclaims all liability for outcomes arising from attempts to use the platform or its AI Features in any prohibited or high-risk scenario.
System and Network Security Requirements
Users must maintain a secure and compliant environment when accessing or using the Service. To help protect both Customer Data and Desku’s infrastructure, Users are required to:
Use strong, unique passwords for all User accounts and safeguard login credentials from unauthorized access or disclosure.
Follow industry-standard security practices, including keeping operating systems, devices, browsers, and network environments properly secured and up to date.
Ensure all integrations, such as WhatsApp, Shopify, Facebook, Slack, and any other connected third-party applications, are correctly configured and maintained with the latest versions and security patches.
Implement appropriate internal access controls, including role-based permissions and Multi-Factor Authentication where available.
Regularly review account activity to identify and address any unusual or suspicious behavior.
Immediately report any potential vulnerabilities, suspected security incidents, or concerns to Desku through approved reporting channels.
Failure to maintain a secure environment may result in restricted access, suspension, or additional security measures imposed by Desku to protect the platform and its Users.
Reporting Violations
Users must promptly report any suspected misuse of the Service, prohibited activity, or security-related concern through the official channels listed below:
Enforcement Actions
Desku reserves the right to take any action necessary to protect the platform, its Users, and its infrastructure. Enforcement measures may vary depending on the nature and severity of the violation. These actions may include:
- Reviewing Customer Content, logs, usage patterns, and account activity to investigate suspected violations of this AUP.
- Restricting or removing access to any content that violates this AUP, poses a security threat, or creates legal risk.
- Temporarily suspending User accounts while an investigation is ongoing or where misuse continues.
- Immediately terminating accounts involved in severe, harmful, repeated, or intentional violations of this AUP.
- Reporting illegal conduct, credible threats, or harmful activity to law enforcement, regulatory agencies, or other appropriate authorities when required or appropriate.
Violations of this Acceptable Use Policy may result in immediate suspension or termination of account access.
Modifications to This Desku AUP
Desku may update, revise, or modify this Acceptable Use Policy at any time to reflect changes in legal requirements, security standards, platform functionality, or business operations. When updates occur, Desku may provide notice through the dashboard, an in-app banner, email communication, or other reasonable methods.
Any modifications become effective once published, unless a later Effective Date is stated. Your continued use of the Service after any update constitutes your acceptance of the revised AUP. If you do not agree to the updated terms, you must stop using the Service immediately.
